Terms of Service & Liability

Binding conditions governing the use of h.k.l.p.g. logistics services and digital platforms under Canadian law.

1. Scope

Service Definition & Applicability

These terms apply to all freight forwarding, hazardous materials transport, and safety management services provided by h.k.l.p.g. (101 Schmidt Port Apt. 400). Use of our website, quote requests, or shipment bookings constitutes acceptance of these conditions. Services are limited to the Transportation of Dangerous Goods Act (TDGA) compliant operations within Canada and cross-border routes explicitly agreed in writing.

2. Obligations

Shipper & Carrier Responsibilities

The shipper must provide accurate classification, safety data sheets, and emergency response information for all dangerous goods. h.k.l.p.g. will verify documentation against TDGA schedules and may refuse shipments that fail to meet placarding, packaging, or labeling standards. Both parties must maintain current training certifications for personnel handling Class 2, 3, 4, 6, 8, and 9 materials.

3. Liability

Limitation of Liability & Indemnification

h.k.l.p.g. liability is limited to direct damages caused by proven negligence, capped at the invoice value of the specific shipment. We are not liable for indirect, consequential, or punitive damages arising from regulatory fines, production delays, or environmental remediation. The shipper indemnifies h.k.l.p.g. against claims resulting from incomplete or inaccurate dangerous goods declarations.

4. Termination

Suspension & Cancellation

Either party may terminate the service agreement with 30 days written notice. h.k.l.p.g. reserves the right to immediately suspend services if the shipper violates TDGA provisions, fails to pay invoices within 45 days, or poses an imminent safety risk. Upon termination, all outstanding fees become due and any hazardous materials in transit will be returned or disposed of at the shipper’s cost.

5. Amendments

Changes to Terms

h.k.l.p.g. may update these terms to reflect changes in Canadian regulations or operational practices. Material changes will be communicated via email to the primary contact on file.
